Terms of Service
Last updated October 26, 2026
01
Acceptance of Terms
By accessing or using ViewGum ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. The Service is operated by Swami Shriji Krupa LLC (see Section 26). We may update these Terms. We will tell you about material changes by email or a notice on the Service before they take effect, and we may ask you to accept the updated Terms to keep using the Service. Continued use after the changes take effect constitutes acceptance.
02
Eligibility
The Service is for people who are 18 years of age or older. By using the Service, you represent that you meet this requirement. We do not knowingly allow anyone under 18 to use the Service. If we learn that a user is under 18, we will delete their account and associated data. To report an account you believe belongs to someone under 18, email legal@viewgum.com. Do not upload footage of a person under 18, and do not submit personal information about a child.
03
Account Registration and Access
You sign in with your Google account. You are responsible for keeping that account secure and for all activity under your ViewGum account. Tell us immediately about any unauthorized access or use. Each person may have one account. Do not create extra or throwaway accounts. We may limit or pause new sign-ups, and we may pause, limit or end access to any account at any time. We are not liable for any loss resulting from unauthorized use of your account.
04
Service Description
ViewGum is an AI short-form video editor. You upload or record your own footage, or start from an idea, and the Service writes scripts, plans and applies edits, adds captions, graphics, music and sound effects, can generate pictures, voiceovers and fictional presenters, and exports vertical videos with post copy for the platforms you choose. Each action that uses credits shows its price before it starts. To do this, the Service uses AI models and other providers that process your uploads, prompts and generated media, including still frames of your video and the audio track (see the Privacy Policy and the subprocessor list). The Service is provided on an "as is" and "as available" basis without guarantees of uptime, accuracy, or fitness for any particular purpose.
05
AI-Generated Content Disclosure
Scripts, titles, descriptions, ideas, edit decisions, post copy, images, voiceovers and other generated media produced by the Service are generated or selected by artificial intelligence. You acknowledge and agree that:
- AI-generated outputs may contain factual errors, omissions, or fabrications and must be reviewed before publishing
- Generated pictures, voiceovers and presenters are synthetic. Presenters supplied by the Service are fictional and do not depict any real person
- Edit decisions (cuts, captions, graphics, framing) are suggestions you review. Captions come from an automatic transcript and may contain errors
- Generated content is not legal, medical, financial, or professional advice
- You are solely responsible for fact-checking, editing, and reviewing all generated content before publishing or distributing it
- We do not guarantee that outputs are unique, original, or free from similarity to existing works
5A
Your Uploads and Recordings
You may upload or record footage, audio, images, logos and other material ("Your Uploads") only if you have the rights to use it in this way. By uploading or recording, you confirm that:
- You own Your Uploads or have permission to use them, including any music, logos or footage of others they contain
- You have the rights and consent for every identifiable person who appears or is heard in Your Uploads: each has agreed to appear in content you publish and to the processing of their face and voice described in the Privacy Policy, and each is 18 or older
- Your Uploads do not contain anyone's private information without their consent
06
Ownership and Intellectual Property
Your content: Subject to these Terms, you retain your rights in Your Uploads and, as between you and us, we assign to you whatever rights we have in the videos you export, so you may use them for personal or commercial purposes, including on social platforms. Copyright law may not protect purely AI-generated material, and we make no promise that you will hold any copyright in it. Music beds and sound effects included by the Service are licensed to you for use in videos you export from the Service, and may not be extracted and redistributed on their own. Fictional presenters, characters and other generated media supplied by the Service may be used in your exported videos, but you may not present them as real people or register them as your own trademark or likeness.
Our content: The Service itself, including its design, code, branding, templates, prompts, style controls, documentation, and all underlying technology, is the property of ViewGum (operated by Swami Shriji Krupa LLC) and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reverse-engineer, or redistribute any part of the Service.
License grant: You grant ViewGum a limited, non-exclusive license to store, process, and display your inputs and generated content solely for the purpose of providing the Service. We do not use your uploads, inputs or generated outputs to train AI models.
Aggregated insights: You also grant us a non-exclusive, royalty-free license to use aggregated, de-identified data derived from your use of the Service (such as the formats and styles chosen and usage patterns, never the content of your uploads) to operate, analyze, and improve the Service. This aggregated data does not identify you personally, is never sold, and does not affect your ownership of your content. See our Privacy Policy (Section 3.1) for details and how to object.

Payments, Billing, and Refunds
Paid plans are billed monthly in advance through Stripe at the rates shown on our pricing page. Your payment method is charged when you subscribe and on each renewal date, and you authorize us to charge it each billing cycle until you cancel. All fees are quoted in US dollars. Payments are processed by Stripe, and your purchase may be completed with Stripe or its affiliate acting as the merchant of record for the transaction, in which case Stripe handles the charge, applicable taxes, and payment receipts.
- You may cancel your subscription at any time in Settings. Access continues through the end of the current billing period.
- Plans include credits each billing period, and you can buy one-time top-ups. Every action that uses credits shows its price before it starts and is charged that price when it starts. If an action fails or you cancel it before it finishes, its credits are returned to your balance automatically.
- Plan credits renew at the start of each billing period and do not roll over.
- Top-up credits are credits you buy once, with or without a plan. They roll over when your plan renews and expire 12 months after purchase. Plan credits are spent before top-up credits.
- Some plans are sold in a limited number of spots. When the spots are taken, the plan shows as sold out and cannot be bought until one opens. This does not change a plan you already have.
- Credits have no cash value, cannot be transferred, and are not refundable as money except where these Terms or the law say otherwise.
- When your credits run out, paid actions stop until your next billing period, a top-up or a plan change. We do not charge overages.
- An upgrade takes effect once it is paid and adds credits for the rest of the period in proportion. A downgrade takes effect at the next billing period.
- First-month refunds are available at our discretion if outputs materially failed to perform; email support@viewgum.com within 30 days of your first paid charge.
- We reserve the right to change pricing with 30 days' notice.
- Failed payments may result in service suspension.
8A
Bonus Credits
We may give promotional bonus credits, such as a welcome bonus when you create an account, a daily bonus when you sign in, or extra credits on a first purchase. The amounts and rules are the ones shown in the app when you get them.
- Bonus credits have no cash value and cannot be sold, transferred or exchanged for money.
- We may change, pause or end any bonus at any time.
- Bonuses are for one account per person. Bonuses gained through extra accounts, automation or other abuse may be removed, and the accounts suspended.
- If a purchase that earned a bonus is refunded, charged back or disputed, we take back the matching bonus credits.
8B
Referral Program
We may offer a program that gives you bonus credits for inviting friends to ViewGum. Taking part is optional, the program may not always be available, and these rules apply along with the rest of these Terms.
- Who can take part: you need an account in good standing with access to the Service. A friend counts only if they are new to ViewGum and create their first account from your link. Each person can be referred once, by one person.
- Join reward: you get the join reward after your friend's account qualifies, which means it passes the waiting period and the first-use steps shown in the app. No purchase is needed for the join reward.
- Paid reward: when your friend makes their first paid purchase (a plan or a top-up), you and your friend each get the paid reward, once per friend. Free trials and no-charge purchases do not count.
- Amounts and limits: reward amounts, the monthly limit on join rewards and the lifetime limit on referral credits are the amounts shown in the app when the reward is earned. A referral over a limit is still listed but earns no credits.
- Referral credits are bonus credits. They have no cash value and cannot be sold, transferred or exchanged for money. We may hold them for review before you can use them.
- Fair play: no referring yourself, no second accounts, and no fake, duplicate, bought or automated accounts. Do not bid on the ViewGum name in search ads.
- Invite only people you know, through your own channels. Do not spam, send bulk messages or message people who have not agreed to hear from you. You are responsible for following the laws that apply to messages you send. We never send invitations on your behalf.
- If you share your link publicly, such as in a post, video, comment or website, say clearly in that post that you get credits when people join (for example, "I get credits if you sign up with my link"). Do not make false or misleading claims about ViewGum.
- Your invite list shows each friend's first name and last initial (or "A friend"), when they joined, whether they made a purchase and the reward status. It never shows their email address or what they spent.
- We may review any referral and withhold, hold or reverse referral credits, or remove you from the program, if we see signs of abuse, fraud or a breach of these Terms, or if the purchase that earned a reward is refunded, charged back or disputed. Reversed credits come off your bonus balance.
- We may change the reward amounts, limits or rules, or pause or end the program, at any time. Credits already added to your balance stay subject to these Terms. The program is void where prohibited by law.
09
Repeat Infringer Policy
In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights. We may also, at our sole discretion, limit access to the Service or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.
10

Non-Consensual Intimate Imagery and Reporting Abuse
We prohibit non-consensual intimate imagery (NCII) and the sexualized depiction of any real, identifiable person created or shared without that person's consent, as stated in the Acceptable Use Policy above. We remove reported NCII quickly and without requiring the reporter to prove ownership of a copyright.
How to report: Anyone can report content for removal using our content report form, or by email to legal@viewgum.com. A report should include a link to the content, the category of the problem, and a short description. If you are the person depicted, please say so.
Our response: For reports of non-consensual intimate imagery, we act on a 48-hour removal clock once we can verify the report, and we log each report for the removal record. We may disable access to the content while we review, and we may suspend or terminate the account responsible. This process is separate from the copyright (DMCA) process in the section above; you do not need to be a copyright owner to report intimate imagery.

No Guarantee of Results, Monetization, or Platform Acceptance
The Service helps you produce short videos and post copy. It does not control how any third-party platform treats what you publish. You acknowledge and agree that:
- We do not guarantee any particular result, including view counts, watch time, followers, revenue, or income
- We do not guarantee that a platform will accept your content, approve you for monetization, or keep you monetized
- We do not guarantee that generated content complies with the policies, community guidelines, or terms of TikTok, Instagram, YouTube, Facebook or any other platform, and platform policies can change at any time
- You are solely responsible for the content you publish, including reviewing it, ensuring it is lawful and compliant in your jurisdiction and on your chosen platform, and making any disclosures required of you
13
Provider Usage Rules
The Service uses AI model, voice, image, video and transcription providers. Those providers have their own usage rules, and you agree not to use the Service in a way that would break them. In general they bar impersonation, content that sexualizes or endangers minors, non-consensual intimate imagery, deceptive political content, fraud, and unlawful content. We may refuse, block or remove a request or an output, and suspend an account, where a provider's rules or the law require it. The providers we use are listed on the subprocessors page.
14
YouTube API Services and Public Creator Data
The creators library and the channel check use YouTube API Services to show public channel and video information, such as titles, public view counts and channel images. These features read public data only and do not access your YouTube account. By using them you agree to be bound by the YouTube Terms of Service, and Google's Privacy Policy applies to that data. We refresh or delete data obtained through YouTube API Services within 30 days. Creator names, channels and images remain the property of their owners and are shown for reference only, without any affiliation or endorsement. If you are a creator or rights holder and want an entry removed, email support@viewgum.com. Formal copyright notices can be submitted under Section 10.
15
Third-Party Services
The Service relies on third-party services, including authentication, payments, database and storage hosting, AI model, voice, image, video and transcription providers, background-job and email providers, and render compute. The current list is on the subprocessors page. We are not responsible for the availability, accuracy, or policies of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
16
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT GENERATED CONTENT WILL ACHIEVE ANY PARTICULAR RESULT (INCLUDING VIEW COUNTS, REVENUE, OR CLICK-THROUGH RATES).
17
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIEWGUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Nothing in these Terms limits any right you have under applicable consumer protection law that cannot be waived.
Nothing in these Terms limits any right you have under applicable consumer protection law that cannot be waived.
18
Indemnification
You agree to indemnify, defend, and hold harmless ViewGum and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you generate, publish, or distribute using the Service.
19
Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration administered under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. You agree that any arbitration shall be conducted on an individual basis and not as a class action. Small claims court actions are exempt from this arbitration requirement. To the fullest extent permitted by law, you and ViewGum each waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action, and agree that claims may be brought only in an individual capacity. These dispute resolution terms, and any dispute not subject to arbitration, are governed by the laws of the State of New Jersey (see the Governing Law section below).
20
Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. You can delete your account yourself in Settings, which cancels billing and removes your media and records as described in the Privacy Policy. When a paid plan ends, your short-form files stay available while you have credits or keep using the Service. If every plan has ended for 30 days, with no activity and no credits left, we may remove your media files; your account, scripts and settings remain until you delete your account. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) shall survive.
21
Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
22
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. To the extent litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in New Jersey.
23
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
24
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViewGum regarding the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
25
Sanctions and Export
You may not use the Service if you are in, or ordinarily live in, Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk or Luhansk regions of Ukraine, or if you are on a US government list of restricted parties. You may not use the Service to export or re-export anything in breach of US export controls and sanctions laws. We may block sign-in and sign-up from those places, and close accounts that break this section.
